Pathwater Inc. Social Media Giveaway Official Rules
1. Eligibility:
- The giveaway is open to people in the US and above 18 years old.
- Employees of Pathwater, Inc and their immediate family members are not eligible to participate.
2. Entry Period:
- The giveaway begins on November 16, 2023 and ends on December 22, 2023.
3. How to Enter:
- Participants must complete the sign up form available through social media.
- Only 1 entry per person is allowed.
4. Prize:
- Winner will receive 2 tickets for the Travis Scott Utopia Circus Maximus tour, in the selected city.
- The prize is non-transferable and cannot be exchanged for cash or other alternatives.
- The city that the winner is selected for is the only city the tickets are eligible for.
5. Winner Selection:
- The winner(s) will be randomly selected roughly 72 hours before the scheduled concert date.
- The winner(s) will be notified through Instagram within 1 day of the drawing.
- If the winner does not respond within 24 hours, a new winner will be selected.
- The winners tickets will be either digitally transferred or available at Will Call for pick up. Additional details to be shared directly with the winners.
6. Publicity:
- By entering the giveaway, participants grant Pathwater, Inc the right to use their name, likeness, and entry for promotional purposes without compensation.
7. Privacy:
- Personal information collected for the giveaway will be used only for the purpose of the giveaway and will not be shared with third parties.
8. General Conditions:
- Pathwater, Inc reserves the right to modify, suspend, or terminate the giveaway in the event that it becomes corrupted or cannot be conducted as planned.
- Pathwater, Inc is not responsible for lost, late, incomplete, or misdirected entries.
9. Governing Law:
- This giveaway is governed by the laws of California. Any disputes arising out of or related to the giveaway shall be resolved in the state or federal courts located within California.
10. Sponsor:
- The giveaway is sponsored by Pathwater, Inc - 44137 Fremont Blvd, Fremont, CA 94538.
11. Mailing list entry
- By signing up for our giveaways agree to be enrolled in our marketing emails.
By participating in the giveaway, participants agree to be bound by these Official Rules.
Pathwater, Inc reserves the right to amend these rules at any time.
12. Custom Bottles
- Documentation Requirement: “You will provide Path with any necessary documentation to support your ownership or right to use the Customer Materials upon request.”
- Injunction Clause: “You acknowledge that Path may, at its discretion, take necessary actions to protect its interests and enforce these terms, including but not limited to seeking injunctive relief.”
- Modification Clause: “Path reserves the right to modify or update these terms and any associated terms at its discretion. Changes will be effective immediately upon posting on our website. Your continued use of our services following the posting of any changes constitutes your acceptance of the modified terms.”
- Reporting IP Claims: “Path is committed to the appropriate and legal use of the intellectual property of others, and we require our users to behave similarly. If you believe your copyright, trademark, or other intellectual property right is being infringed by a user of the Path Custom Studio, please provide written notice to the following agent for notice of claims of infringement: 44137 Fremont Blvd, Fremont, CA 94538. In order for us to respond to your notice, it must: (i) contain your physical or electronic signature; (ii) identify the copyrighted work, trademark, or other intellectual property alleged to have been infringed; (iii) identify the allegedly infringing material in a sufficiently precise manner to allow us to locate that material; (iv) contain adequate information by which we can contact you (including postal address, telephone number, and e-mail address); (v) contain a statement that you have a good faith belief that use of the copyrighted material, trademark, or other intellectual property is not authorized by the owner, the owner's agent, or under applicable law; (vi) contain a statement that the information in the written notice is accurate; and (vii) contain a statement, under penalty of perjury, that you are authorized to act on behalf of the copyright, trademark, or other intellectual property right owner.”"
